Terms and Conditions

 

INGREDIENTS

All of my ingredients are of the highest quality. However, since our kitchens may handle or come in contact with milk or milk products, wheat, nuts, soy and other allergens, I cannot guarantee that it will not be found in our Products and therefore we do not accept any liability for any damage to health or any distress caused to you by the consumption of such Products.  You agree to notify your guests of this risk and hold me harmless due any allergic reactions.

ORDERS

How many days for Cake Orders, Cupcakes, or CakePops?

The cake/cupcake/cakepop orders must be placed at least a week in advanced, however if you require either one sooner; you can try to contact me to see if I can satisfy your needs subject to the availability of the date required.

Any cake ordered from a picture or photo of a cake produced by any other cake maker, can only be reproduced by cake for all occasions as our interpretation of that cake and will not be an exact reproduction of the cake in the picture or photo.

How many days for Cookies orders?

Two weeks in advance.  Any cookie ordered from a picture or photo of a cookie produced by any other cookie maker, can only be reproduced as our interpretation of that cookie and will not be an exact reproduction of the cookie in the picture or photo.

ALTERATIONS TO ORDERS

Any amendment to your order must be confirmed via email/writing as soon as possible, and may be subject to an additional charge if extra work is required.  Michelle Mark reserves the right to refuse alterations and amendments We will do our best to accommodate last minute changes, but this cannot be guaranteed.

PAYMENTS

A deposit of 50% is payable at the time of booking your cake to reserve your event date or order fulfillment. Your chosen date will be held for you for 3 days from the time of booking. If the deposit is not paid within that time, the date will be made available to others and your order will not be fulfilled.

If an order is cancelled after it has been booked, we lose business from potential clients that were turned away to reserve your event date. Additionally, all of our baked goods which include Cakes, Cupcakes, Cookies, and CakePops are custom made to order using perishable, time sensitive ingredients.  For those reasons, all deposits and/or payments made in full are non-refundable and non-transferable, if an order is cancelled.

Once an order is requested and/or a deposit made, it is an acceptance of the terms and conditions in lieu of signing an agreement. Once order is processed, the client agrees to the terms and conditions set forth on this page.

RETURN POLICY AND DISPUTES

Made by Michelle Mark strive to make every customer happy.  It is your responsibility to ensure the cake is as per your requirements prior to taking receipt of it.  Any refund given for disputes regarding a cake design or production of any design or any type of baked goods or products are completely at the discretion of Michelle Mark including if upon collection of the Product(s) you find that they are not those ordered by you (for example, the topping or wording is incorrect), or the order is incomplete, or a Product is in a damaged condition when you receive it, are subject to it being reported on the claimed damage and to these Terms and Conditions.  Refunds will never be given for any purchased product which has been consumed regardless of dispute, as consumption of the cake/cupcakes/cookie/cakepop or any consumable purchased product is viewed as your acceptance that the product is adequate for the purpose for which it has been supplied.

Photos will be taken prior to pickup (or once delivered if the cake is to be delivered) to prove quality. Please note that no responsibility will be taken for loss or damage of the cake after collection or delivery has taken place.  We do not accept any responsibility for loss or damage to the Product once the cake has been delivered to a venue or collected from my shop, or for loss, damage or non-delivery under unavoidable or exceptional circumstances.  We cannot accept responsibility for damage caused by you or by a courier/agent/friend engaged by you to collect Products from us, when they are damaged during transit to your home or destination.  We will have no liability to you for any indirect loss.

Since taste is a very personal matter and subjective we cannot accept the return of any Products merely because you do not like the taste.

RETURN OF HIRED EQUIPMENT

Deposits are taken for all equipment.   All equipment must be returned within 3 days  (unless alternative arrangements have been agreed prior to in writing) or extra charges may be levied to cover hire costs.  Any damages to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.

ACKNOWLEDGEMENTS

You acknowledge that we may change the terms of this Agreement by posting a new Agreement on this Web Site. You acknowledge that it is your responsibility to check the Site regularly to ascertain if changes have been made and your continued use of the Site after such a change will constitute your acceptance of the changes. By reading this Agreement you acknowledge that you have read, understood and agree to be bound by the Terms and Conditions of this Agreement.
